2. Rights of the data subjects

You have the right: 

•    in accordance with Art. 15 GDPR to request information about the personal data which we process. Insofar as we process your data, you can in particular request information about the purposes of processing, the category of personal data, the categories of recipients, to whom your data have been or will be disclosed, in particular regarding recipients in third-countries, the planned period of storage or the criteria for stipulation of the latter, the existence of a right to correction, deletion, limitation of processing or withdrawal of consent to processing, the existence of a right to object to a supervisory authority, the origin of your data, insofar as they were not collected by us, as well as the existence of automated decision-making including profiling and if applicable significant information about details of the latter;
•    in accordance with Art. 16 GDPR to request the immediate correction of incorrect personal data or completion of the latter which we have stored;
•    in accordance with Art. 17 GDPR to request the deletion of your personal data which we have stored, insofar as processing is not necessary in particular to exercise the right to freedom of expression and information, to satisfy a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
•    in accordance with Art. 18 GDPR to request the limitation of the processing of your personal data, insofar as you are disputing the accuracy of the data, the processing is unlawful, but you refuse their deletion and we no longer require the data, but you need them to assert, exercise or defend legal claims or in accordance with Art. 21 GDPR you have submitted a withdrawal of consent to processing and it is not yet certain whether our justified reasons exceed your interests;
•    in accordance with Art. 20 GDPR to receive your personal data, which you have provided to us, in a structured, current and machine-readable format or request transmission to a different officer, insofar as processing is based on your consent or a contract and processing takes place using an automated procedure;
•    in accordance with Art. 7 Para. 3 GDPR to withdraw the consent which you once granted to us at any time. This means that we are no longer permitted to continue the data processing, which was based on this consent, in the future and
•    in accordance with Art. 77 GDPR to complain to a supervisory authority. In general you can consult the supervisory authority at your normal place of residence or work or the registered office of our company.

3. Right to withdraw consent
Insofar as your personal data are processed on the basis of justified interests in accordance with Art. 6 Para. 1 Clause 1 lit. e or f GDPR, you have the right in accordance with Art. 21 GDPR to submit a withdrawal of consent for the processing of your personal data, insofar as there are reasons for this, which arise from your particular situation or the withdrawal of consent is directed against direct advertising.
In the first case mentioned above, we will no longer process your data unless we can provide evidence of urgent grounds, which outweigh your interests, freedoms and rights or our processing is to assert, exercise or defend legal claims.
In the last case, you have a general right to withdraw consent, which we will implement without the need for you to state a particular situation. If you would like to make use of your right to withdraw consent or right of objection, an email to info(at)bthvn2020.de is sufficient.   
 

4. Transmission of data
Your personal data will not be transmitted to a third party for purposes other than those stated below. We will transmit your personal data to a third party only if:
•    You have given your express consent for this in accordance with Art. 6 Para. 1 Clause 1 lit. a GDPR,
•    Transmission is necessary in accordance with Art. 6 Para. 1 Clause 1 lit. f GDPR to assert, exercise or defend legal claims and there is no reason to assume that you have an overwhelming interest worthy of protection in the non-transmission of your data,
•    In the event that there is a statutory obligation for transmission in accordance with Art. 6 Para. 1 Clause 1 lit. c GDPR, and
•    this is permitted by law and is necessary for dealing with contractual relationships with you in accordance with Art. 6 Para. 1 Clause 1 lit. b GDPR.
In addition, our order processing staff will receive your personal data for processing associated with instructions, insofar as this is necessary to satisfy the order. Our order processing staff do not have their own right to use your data.

5. Data security
Within the website visit we use the widespread SSL procedure (Secure Socket Layer) in conjunction with the relevant highest level of encryption, which is supported by your browser. In general this is 256-bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v3 technology instead. You will be able to identify whether an individual page of our website is transmitted with encryption by the closed display of the key or lock symbol or the use of https before the address of our (sub-)website. As for the rest, we use suitable technical and organisational security measures to protect your data against accidental or intentional manipulations, partial or complete loss, destruction or against unauthorised access by a third party. Our security measures are continually being improved in line with technological development.

6. Third countries
Data will be transmitted to third countries by us exclusively in accordance with the statutory regulations.
Insofar as we satisfy our contract with you, data will be made available to a third party. Suitable guarantees in accordance with Art. 46 GDPR or an adequacy decision in accordance with Art. 45 GDPR are not required for this.
Insofar as you have not given your consent to data transmission, the data transmission does not serve the satisfaction of the contract or the transmission is necessary to assert, exercise or defend legal claims, the data will be transmitted by us only if suitable guarantees or an adequacy decision exist.
A suitable guarantee exists for example if the EU standard data protection clauses issued by the EU Commission have been concluded or if a certification is available through a “Privacy Shield”.

The legal basis is Art. 45 and 46 GDPR.

Special data protection information on the data processing processes on the website

1. When visiting the website
When you visit our website, the browser used on your end-device will automatically send information to the server of our website. This  information will be stored temporarily in a so-called log file. While doing so, the following information will be collected without any action on your part and stored until automated deletion:
•    IP-address of the computer making the inquiry,
•    date and time of access,
•    name and URL of the file downloaded,
•    website, from which access takes place (referrer-URL),
•    browser used and if applicable the operating system of your computer as well as the name of your access-provider.
The above-mentioned data will be processed by us for the following purposes:
•    Ensuring problem-free building-up of connections on the website,
•    Ensuring it is easy to use our website,
•    Assessing system security and stability as well as
•    for additional administrative purposes.
The legal basis for data processing is Art. 6 Para. 1 Clause 1 lit. f GDPR. Our justified interest exists in the operation of our website and the image of our company associated with this.
Your data will be deleted as soon as they are no longer required for the purposes indicated, no later than after six months.
 

2. When using our contact form or other ways of making contact
If you have questions of any kind, we offer you the opportunity to contact us by using the form provided on the website or via the contact details indicated on the website. Your name and a valid email address must be stated on the contact form so that we know from whom the inquiry originates and so that we can respond. You can provide additional information voluntarily, for example so that we can answer your inquiry in a different way.
Data processing for the purposes of making contact with us takes place in accordance with Art. 6 Para. 1 Clause 1 lit. a GDPR on the basis of your consent, which has been granted voluntarily. The personal data collected by us, which is necessary for communication, will be automatically deleted after your query has been dealt with.
If your inquiry seeks to conclude a contract, Art. 6 Para. 1 Clause 1 lit. b) GDPR serves as the legal basis. In this case we will store your data for the duration of the statutory periods of retention.
 

3. When registering for our Newsletter
Insofar as you have expressly given your consent in accordance with Art. 6 Para. 1 Clause 1 lit. a GDPR, we will use your email address to send you our Newsletter on a regular basis. Providing an email address is sufficient to receive the Newsletter. You can provide your name voluntarily. It is possible to unsubscribe at any time, for example by using the form on our website or a link at the end of every Newsletter. Alternatively you can also send your wish to unsubscribe at any time to info(at)bthvn2020.de by email.
We store your data until you withdraw consent.

4. For applications and in the application procedure
It is particularly important to Beethoven Jubiläums GmbH to ensure the highest possible level of protection for your personal data. All the personal data, which is collected and processed as part of an application, will be protected through technical and organisational measures against unauthorised access and manipulation.
We require your personal data in the application documentation to be able to consider you as an applicant in the application process and to review whether you will be under consideration to become an employee in our company. Insofar as you provide information, which exceeds the required details, you are providing this to us voluntarily and declare that you are in agreement with processing.
The legal basis for processing is therefore Art. 6 Para. 1 Clause 1 lit. a and b GDPR. The withdrawal of consent is possible at any time. You can send your withdrawal of consent at any time to info(at)bthvn2020.de by email.
At the end of the application procedure, we will store your documentation for a further six months for purposes of proof.
If you wish to conclude a contract, it is necessary that you provide your personal data to us in the application documentation. Otherwise we will not be able to consider you in the application procedure.

5. When registering for access to the internal system for project partners
You have the opportunity to register on our website as a project partner in order to obtain access to the internal system. The information is required to provide you with access and prepare our range of services.
The legal basis for processing is Art. 6 para. 1 Clause 1 lit. b GDPR.
You can adjust the information in your user profile at any time.
We process your data for the period during which you are registered as a project partner.
If you do not provide the requested information to us, you cannot register as a project partner.

6. When registering an establishment for sponsorship (sponsorship database)
You have the opportunity to register on our website as an establishment for the sponsorship database in order to apply for sponsorship. The information is required to provide you with access and make sponsorship possible.
The legal basis for processing is Art. 6 para. 1 Clause 1 lit. b GDPR.
You can adjust the information in your user profile at any time.
We process your data for the period during which you are registered in the sponsorship database.
If you do not provide the requested information to us, you will not be able to register.
 

7. When using the comments function in the blog
The information in the comments form is required to review your comments and contact you if necessary. The legal basis for processing is Art. 6 Para. 1 Clause 1 lit. a GDPR. By commenting, you declare that you are in agreement that the comment will be made publicly accessible with the name you have entered under the item about which the comment has been made. Your email address will not be published.
We store the comments and your personal data until you withdraw your consent or we discontinue the blog.
 

8.  Cookies, analysis tools, plug-ins and other elements of a third party
We use cookies on our website. These are small files, which your browser creates automatically and which are saved on your end-device (laptop, tablet, Smartphone or similar). Cookies do not damage your end-device, do not contain any viruses, Trojans or other malware. Information is filed in the cookie, which results in connection with the end-device that has been used in the specific case. However, this does not mean that we receive direct knowledge of your identity as a result.
The analysis tools we use assess the user behaviour of visitors to the website and enable us to optimise the website and adjust our marketing measures.

(4) Facebook pixel
We use the Facebook pixel of Facebook, Inc. (1601 Willow Road, Menlo Park, California 94025, USA). This enables conversions to be tracked, a re-targeting of website visitors and additional information to be obtained about members, who are looking at adverts. We use your personal data to display advertising to you, which is of interest to you and therefore makes our website more interesting for you.
The Facebook pixel enables the collection of data on visits to this website, including the URL, referrer-URL, IP-address, device and browser characteristics (user agent) and time stamp.
Facebook does not share any personal data with us, but offers only summarised reports about the website target group and the advertising performance.
